Refund Terms and Conditions Between User (You/Your/User) and Draftspotting Technologies Private Limited and its respective affiliates (“SpotDraft”, “Company”) for eStamp Procurement Services
Please read these Refund Terms and Conditions (“Terms”) carefully before using the Company's eStamp procurement services. These Terms govern the return and refund terms applicable to Your ("User", "You") use of the services provided by Draftspotting Technologies Private Limited or its affiliates ("Company") for procuring eStamps through the third-party Payment Gateway used to process Payments for such services.
By using the Company's eStamp procurement services or making a Payment through the Payment Gateway, You acknowledge that You have read, understood, and agree to be bound by these Terms. If You do not agree with any part of these Terms, please refrain from using the Company's eStamp procurement services.
1. Acceptance of Terms
By using the Company's eStamp procurement services or making a Payment through the Payment Gateway, You agree to comply with these Terms, the terms and conditions applicable to the eStamp Procurement Services as agreed between You and SpotDraft, applicable laws, and the terms of service of the Payment Gateway used for processing Payments.
2. Definitions
a. eStamp: An electronic version of government-issued stamp paper used to pay stamp duty on legal documents. It serves as proof of Payment and is required for various legal transactions.
b. Payment Gateway: A third-party service provider used by the Company to process Payments for the procurement of eStamps. This provider may have its own terms and conditions that You must accept to use the Payment services.
c. Payment: Any amount received by the Company through a Payment Gateway to procure eStamps.
d. Service Fee: The convenience fee payable to the Company by the User for stamp procurement and management, including but not limited to scanning, uploading, and courier services.
e. Platform Fees: The fees charged by the Payment Gateway for processing the transaction. These may be charged as a percentage of the total transaction amount or as a fixed fee.
f. Total Fees: The total amount charged to the User for the eStamp procurement service, including but not limited to the stamp duty, Service Fees, Platform Fees, and any other applicable charges.
3. Payment and Fees
a. Fees: The applicable Total Fees for eStamp services will be displayed at the time of Payment. The Company reserves the right to change the fee structure at any time.
b. GST and Invoices: A GST invoice will be issued only for the fees retained by the Company.
c. Refunds: Refunds for Payments made via the Payment Gateway are subject to the Cancellation and Refund Policy set out below.
4. Cancellation and Refund Policy
a. No Refunds on Stamp Duty: Once a Payment for stamp duty has been processed and an eStamp has been issued, it cannot be modified, cancelled, or refunded under any circumstances.
b. User Errors: The Company is not responsible for errors made by Users in the information submitted while procuring an eStamp. The User shall be responsible for the accuracy of the information provided.
c. Duplicate Payments: In the event of a duplicate Payment, You should contact the Company at estamp@spotdraft.com with proof of the excess Payment (transaction reference number and bank statement). The Company will investigate and, if applicable, issue a refund for the duplicate Payment, less any applicable Platform Fees.
d. Refund Policy: If a refund is deemed appropriate because of duplicate payments, it will be processed to Your original Payment method within 5–7 business days, after deducting any applicable Service Fees and Platform Fees.
